We use variation in corruption convictions across judicial districts in the US to examine the relationship between political corruption and risk-taking of public firms. Firms headquartered in regions with high levels of political corruption have lower total risk and lower idiosyncratic risk on average. Further analysis shows that corruption tends to encourage firms to pursue risk-decreasing investments, lower the riskiness of their operations, and decrease asset liquidity. While managerial ownership is intended to align the interests of managers and shareholders, the (...) presence of corruption appears to encourage undiversified managers to decrease risk-taking. Our evidence is consistent with agency theory and the asset-shielding argument that political corruption discourages managers from taking risks that expose firms to expropriation by politicians, resulting in suboptimal corporate policies. We present an argument-based formalism of contract dispute resolution following a modern view that the court would resolve a contract dispute by enforcing an interpretation of contract that reasonably represents the mutual intention of contract parties. Legal doctrines provide principles, rules and guidelines for the court to objectively arrive at such an interpretation. In this paper, we establish the appropriateness of the formalism by applying it to resolve disputes about performance relief with the legal doctrines of impossibility and frustration of (...) purpose in common laws of contract. This paper examines Jacques Derrida's deconstruction of Giorgio Agamben's account of the history of bio-politics in the Beast and the Sovereign. In this account, the ‘threshold of bio-political modernity’ is identified with the collapse of an allegedly immemorial distinction between life and the law. According to Derrida, however, this in-distinction between life and the law, which supposedly marks the historical emergence of the bio-political, is in fact an originary event. Agamben, therefore, announces a bio-political modernity that has always already existed. (...) In this essay, I argue that Derrida, in the Beast and the Sovereign, fails to grasp the significance of one of the principal figures employed in Agamben's theory of the bio-political, the ‘threshold’. This figure, which Agamben opposes, elsewhere in his writings, to the Derridean notion of difference/deferral, does not refer to either an historical beginning or something that has always already existed. Rather, the threshold is defined as a particular moment in which an originary phenomenon becomes a decisive historical norm. In his ‘history’ of the bio-political, therefore, Agamben identifies the modernity of the latter in terms of the historical normalization of an in-distinction between law and life that has always already occurred. This paper explores the relationship between revolution and corruption in Jean Genet’s accounts of the Palestinian movement in his final work, Prisoner of Love. For Genet, corruption does not simply expose the actions of a revolutionary subject as an empty impersonation, performed for the actual ends of acquiring personal power and fortune. Rather, it exposes the ‘pretension’ inherent in the revolution it undermines as well as in the accumulation of value. For Genet, the misappropriation of money by the Palestinian leadership (...) makes manifest the imaginary character of both devotion to a revolutionary cause and greed for the commodity-fetish. Corruption, in other words, betrays revolution as well as the ‘imaginary wealth and power’ which the ‘game of revolution’ attempts to destroy. (shrink)

This essay considers Deleuze and Guattari’s paradoxical claim that Marx’s critique of political economy implies as a universal history derived from the singular features of capitalism. In this critique, capitalism is defined by the commodity form, as a relationship of economic equivalence that replaces the bonds of dependence underlying other social formations. By negating relations of kinship and caste, capitalism reveals, a contrario, the universal foundation of other societies. As the “negative of all social formations,” capitalism conditions a universal history, (...) defined, retrospectively, from the singular standpoint of a society, based upon the negation of kinship and caste. In this universal history, moreover, the negation of capitalism is identified with the possibility of a new and equally singular form of society. In Anti-Oedipus, the latter is defined as a “schizophrenic” condition liberated from the commodity as well as from the bonds of dependence that constituted the universal foundation of earlier societies. This article sheds light on the diversity of meanings and connotations that tend to be lost or hidden in translations between different conceptualizations of nature in East and South-East Asia. It reviews the idea of “nature” in Chinese, Japanese, Vietnamese, Filipino, Tagalog, Cebuano, Lumad, Indonesian, Burmese, Nepali, Khmer, and Mongolian. It shows that the conceptual subtleties in the conceptualization of nature often hide wider and deeper cosmological mismatches. It concludes by suggesting that these diverse voices need to be represented in (...) global reports on sustainability, which can be fostered by the direct involvement of experts from diverse traditions of thought who have access and interpretative knowledge of sources in languages other than English. To take into consideration the diversity of conceptualizations of nature can lead to better decisions about sustainability and improve the acceptability and efficiency of environmental policies in each local context, as well as internationally. Art can be addressed, not just to individuals, but to groups. Art can even be part of how groups think to themselves – how they keep a grip on their values over time. I focus on monuments as a case study. Monuments, I claim, can function as a commitment to a group value, for the sake of long-term action guidance. Art can function here where charters and mission statements cannot, precisely because of art’s powers to capture subtlety and emotion. In (...) particular, art can serve as the vessel for group emotions, by making emotional content sufficiently public so as to be the object of a group commitment. In this ethical assessment, most bioethicists, myself included, have discussed how AI/ML violates the ethical principle of autonomy. The commonly cited definition of autonomy comes from Beauchamp and Childress's Principles of Biomedical Ethics (2019), where autonomy is the right of the individual to make decisions for themselves. However, autonomy regarding AI/ML in healthcare has not been or is rarely discussed from the feminist perspective. In Live Like Nobody Is Watching: Relational Autonomy in the Age of Artificial Intelligence Health Monitoring (further referred to as Live Like Nobody Is Watching), Anita Ho, in addition to other points, argues that AI for health monitoring needs to be examined through a relational autonomy lens. Not only is this perspective innovative but it also shows how a predominantly male field has shaped the narrative surrounding AI/ML. In this review, I provide a brief overview of the chapters, explore Ho's arguments for relational autonomy, and discuss future applications of this work.Live Like Nobody Is Watching begins with a preface where the readers are introduced to a real-life scenario. Ho describes a friend's experience of [End Page 101] debating with themself whether to use surveillance for their mother with early-stage dementia who claims someone has been moving her things. This sets up the rest of the book in which questions of should these technologies be used and in what context are they appropriate are debated using relational autonomy. The introduction serves as a brief primer to AI (ML and deep learning) and its role in healthcare followed by a layout of the subsequent chapters. Chapter 1 connects health monitoring AI with relational autonomy, where Ho suggests that the liberal view of autonomy is not appropriate for health monitoring technologies. This is due to the fact that the patient populations using these technologies are reliant, to various degrees, on social relationships. In chapters 2, 3, and 4, Ho addresses how health-monitoring AI requires relational autonomy through use cases concerning home-health monitoring, direct-to-consumer monitoring, and AI monitoring for medication adherence. Throughout these chapters, Ho discusses the claimed benefits of these AI/ML interventions and cautions about the ethical challenges, such as health inequities and testimonial injustice, that can arise with these technologies. Finally, chapter 5 serves as the conclusion, where Ho ultimately argues that health-monitoring AI should be viewed through relational autonomy instead of the traditional view, and she advocates for dialogic engagement (including bringing patients/patients' families into the conversation). The narrative goes full circle with the events in the preface being addressed in the epilogue, where the friend decided to incorporate a smart frame device that would allow them to have video calls with their mother. However, the friend is still grappling with the idea of surveillance given an incident in which another dementia resident accidentally wandered into their mother's room. To this, Ho ends the book by proposing better lighting in the hallways rather than immediately turning to the next high-tech innovation.Ho presents several arguments throughout the book but emphasizes the main argument that relational autonomy should be practiced over the traditional, liberal view of autonomy. Ho discusses the three elements of socio-relational autonomy (using Catriona Mackenzie's work): self-governance, self-determination, and self-authorization. Components of the traditional bioethical view of autonomy are seen in these three elements, with the process of informed consent being closely tied to the concept of autonomy. Under the traditional view, an autonomous individual should have decision-making capacity and be able to make a decision based on the information provided to them without coercion. Studying the psychology behind the purchase of eco-friendly products and second-hand items can offer valuable insights to promote sustainable consumer behavior. This paper examines factors influencing Italian consumers’ willingness to pay regarding bio-based clothing and second-hand items. Drawing from data collected from 402 Italian participants, we examine how motivations and socio-demographic factors are associated with willingness to pay in the context of sustainable fashion. Our findings reveal that motivations related to environmental concerns are positively associated with consumers’ willingness to pay (...) higher premiums for bio-based clothing. Higher income and education levels are also associated with the willingness to pay higher premiums. Meanwhile, motivation related to vintage appeal is associated with lower desired discounts for second-hand items, particularly among older consumers. Gender differences also influence discount preferences, with men seeking larger discounts on second-hand clothing compared to women. By providing insights into Italian consumers’ sustainable fashion choices, this study offers implications for businesses, policymakers, and researchers aiming to promote eco-conscious consumption and sustainability in the fashion industry. Value capture occurs when an agent’s values are rich and subtle; they enter a social environment that presents simplified — typically quantified — versions of those values; and those simplified articulations come to dominate their practical reasoning. Examples include becoming motivated by FitBit’s step counts, Twitter Likes and Re-tweets, citation rates, ranked lists of best schools, and Grade Point Averages. We are vulnerable to value capture because of the competitive advantage that such crisp and clear expressions of value have in (...) our private reasoning and our public justification. There is, however, a price. In value capture, we take a central component of our autonomy — our ongoing deliberation over the exact articulation of our values — and we outsource it. And the metrics to which we outsource usually engineered for the interests of some external force, like a large-scale institution’s interest in cross-contextual comprehensibility and quick aggregability. That outsourcing cuts off one of the key benefits to personal deliberation. In value capture, we no longer adjust our values and their articulations in light of own rich experience of the world. Our values should often be carefully tailored to our particular selves or our small-scale communities, but in value capture, we buy our values off the rack. In some cases – like decreasing CO2 emissions – the costs of non-tailored values are outweighed by the benefit of precise collective coordination. In other cases, like in our aesthetic lives, they are not. This suggests that we should want different values suited to different scales. We should want value federalism. Some values are perhaps best pursued at the largest-scale level, others at smaller scales. The problem occurs when we exhibit an excess preference for the largest-scale values – when we consistently let the universal metrics swamp our quieter interests. (shrink)

There seems to be a deep tension between two aspects of aesthetic appreciation. On the one hand, we care about getting things right. On the other hand, we demand autonomy. We want appreciators to arrive at their aesthetic judgments through their own cognitive efforts, rather than deferring to experts. These two demands seem to be in tension; after all, if we want to get the right judgments, we should defer to the judgments of experts. The best explanation, I suggest, is (...) that aesthetic appreciation is something like a game. When we play a game, we try to win. But often, winning isn’t the point; playing is. Aesthetic appreciation involves the same flipped motivational structure: we aim at the goal of correctness, but having correct judgments isn’t the point. The point is the engaged process of interpreting, investigating, and exploring the aesthetic object. Deferring to aesthetic testimony, then, makes the same mistake as looking up the answer to a puzzle, rather than solving it for oneself. The shortcut defeats the whole point. This suggests a new account of aesthetic value: the engagement account. Plain Semi-Post algebras are in this paper singled out among semi-Post algebras because of their simplicity, greatest similarity with Post algebras as well as their importance in logics for approximation reasoning ([Ra87a], [Ra87b], [RaEp87]). They are pseudo-Boolean algebras generated in a sense by corresponding Boolean algebras and a poset T. Every element has a unique descending representation by means of elements in a corresponding (...) Boolean algebra and primitive Post constants which form a poset T. An axiomatization and another characterization, subalgebras, homomorphisms, congruences determined by special filters and a representability theory of these algebras, connected with that for Boolean algebras, are the subject of this paper. I propose to study one problem for epistemic dependence on experts: how to locate experts on what I will call cognitive islands. Cognitive islands are those domains for knowledge in which expertise is required to evaluate other experts. They exist under two conditions: first, that there is no test for expertise available to the inexpert; and second, that the domain is not linked to another domain with such a test. Cognitive islands are the places where we have the fewest resources (...) for evaluating experts, which makes our expert dependences particularly risky. -/- Some have argued that cognitive islands lead to the complete unusability of expert testimony: that anybody who needs expert advice on a cognitive island will be entirely unable to find it. I argue against this radical form of pessimism, but propose a more moderate alternative. I demonstrate that we have some resources for finding experts on cognitive islands, but that cognitive islands leave us vulnerable to an epistemic trap which I will call runaway echo chambers. In a runaway echo chamber, our inexpertise may lead us to pick out bad experts, which will simply reinforce our mistaken beliefs and sensibilities. (shrink)

It contains a wealth of original educational theory on a variety of topics, including the function of education, the subject, goal, content, and methodology of practical learning. Fukuzawa Yukichi's perspectives on practical learning still prove to have historical influence on the development of education today.

In our life with science, we trust experts; we form judgements by inference from past evidence. We conduct ourselves very differently in the aesthetic domain. We avoid deferring to aesthetic experts. We form our judgements through direct perception of particulars rather than through inference. Why the difference? I suggest that we avoid aesthetic testimony and aesthetic inference, not because they’re unusable, but because we have adopted social norms to avoid them. Aesthetic appreciation turns out to be something like a game. (...) We have laid down certain rules and restrictions in order to shape a kind of activity we cherish. And aesthetic properties turn out to be a kind of social construct. Much like the goal of a game, they are constituted in part by our obedience to certain rules. The norms of aesthetic life are different from those of science because our purposes are different. We engage in science to get the right answers; we engage in aesthetic appreciation to be absorbed in the activity of the sensuous perception of particulars. Our aesthetic practices are a constructed shelter from science; they restore to us a small domain where we may once again engage in our own sensuous perception of particulars. (shrink)

What is the primary intellectual aim of philosophy? The standard view is that philosophy aims to provide true answers to philosophical questions. But if our aim is to settle controversy by answering such questions, our discipline is an embarrassing failure. Moreover, taking philosophy to aim at providing true answers to these questions leads to a variety of puzzles: How do we account for philosophical expertise? How is philosophical progress possible? Why do job search committees not care about the truth or (...) falsity of a candidate’s philosophical views? We argue that philosophy does not aim at discovering true answers to philosophical questions. Instead, its primary intellectual aim is understanding. We argue that many familiar aspects of philosophy become intelligible once we accept this hypothesis. (shrink)

Climate change has become one of the most pressing problems that can threaten the existence and development of humans around the globe. Almost all climate scientists have agreed that climate change is happening and is caused mainly by greenhouse gas emissions induced by anthropogenic activities. However, some groups still deny this fact or do not believe that climate change results from human activities. This essay discusses the causes, significance, and skeptical arguments of climate change denialism, as well as the roles (...) of scientists and science communication in addressing the issues. Through this essay, we call for the active participation of scientists in science communication activities with the public, the opening of new science communication sectors specified for climate change, and more attention to social sciences and humanities in addressing climate change issues. Solidarity is a valuable tradition of Vietnam Communist Party and Vietnamese people and Ho Chi Minh is the personification of the great national Solidarity. What could ground normative restrictions concerning cultural appropriation which are not grounded by independent considerations such as property rights or harm? We propose that such restrictions can be grounded by considerations of intimacy. Consider the familiar phenomenon of interpersonal intimacy. Certain aspects of personal life and interpersonal relationships are afforded various protections in virtue of being intimate. We argue that an analogous phenomenon exists at the level of large groups. In many cases, members of a group engage in shared practices (...) that contribute to a sense of common identity, such as wearing certain hair or clothing styles or performing a certain style of music. Participation in such practices can generate relations of group intimacy, which can ground certain prerogatives in much the same way that interpersonal intimacy can. One such prerogative is making what we call an appropriation claim. An appropriation claim is a request from a group member that non-members refrain from appropriating a given element of the group’s culture. Ignoring appropriation claims can constitute a breach of intimacy. But, we argue, just as for the prerogatives of interpersonal intimacy, in many cases there is no prior fact of the matter about whether the appropriation of a given cultural practice constitutes a breach of intimacy. This study aims at putting characterology to the test of the epistemology presented in J.C. Pariente's work, Language and the Individual. This epistemology requires certain conditions for a knowledge of the individual to be valid, i.e., to be at the same time conceptual and adapted to its individual object. By following characterologists in their work, the study concludes that the characterological processes have met the conditions demanded by Pariente's epistemology. So, one cannot say that characterology, like history, "is not a (...) conceptual knowledge of its object". (shrink)

In this paper, semi-Post algebras are introduced and investigated. The generalized Post algebras are subcases of semi-Post algebras. The so called primitive Post constants constitute an arbitrary partially ordered set, not necessarily connected as in the case of the generalized Post algebras examined in [3]. By this generalization, semi-Post products can be defined. abstract: This article compares and contrasts the Ignatian concept of consolation without previous cause with the Zen Buddhist concept of satori. The aim is to underscore a unique but not commonly recognized characteristic of Ignatian contemplation and promote interreligious understanding. I argue that Ignatian prayer methods, though primarily kataphatic in their approach, share common features with apophatic spirituality and Zen meditation, even though Zen does not make any reference to God. This article consists of three main parts: In the first (...) part, I delve into Ignatius's own religious experience, particularly the experiences he had during eleven months in Manresa, and interpret these experiences from the lens of the Ignatian consolation without previous cause. In the second part, I explore the overall goal of Zen, focusing on the discussion of Zen sunyata and satori. In the final part, I draw out points of contact and differences between the Ignatian concept of consolation without previous cause and Zen satori with an aim toward better appropriating the Ignatian consolation without previous cause from Zen satori. In doing so, I hope to make Ignatian spirituality more appealing and available to spiritual seekers across religious traditions. (shrink)

Much of the literature supports the moral development theory as a justification for teachers to care, where teachers should care for their students because it contributes to their moral education as caring persons. If no causal relationship can be established, the question remains whether we would want teachers to care, preferably one that does not merely import its external normative significance into teaching. I argue that an understanding of teaching, and moreover, of good teaching already has embedded within it conceptions (...) of care. Understanding that teaching involves care would then challenge virtue/character-based conceptions of the good teacher. While these clarifications are modest in scope, taking caring seriously in teaching has implications on how we conceptualize the good teacher, which in turn affects how both teacher education and professional ethics might be understood. Games have a complex, and seemingly paradoxical structure: they are both competitive and cooperative, and the competitive element is required for the cooperative element to work out. They are mechanisms for transforming competition into cooperation. Several contemporary philosophers of sport have located the primary mechanism of conversion in the mental attitudes of the players. I argue that these views cannot capture the phenomenological complexity of game-play, nor the difficulty and moral complexity of achieving cooperation through game-play. In this paper, I (...) present a different account of the relationship between competition and cooperation. My view is a distributed view of the conversion: success depends on a large number of features. First, the players must achieve the right motivational state: playing for the sake of the struggle, rather than to win. What is the value of intellectual playfulness? Traditional characterizations of the ideal thinker often leave out playfulness; the ideal inquirer is supposed to be sober, careful, and conscientiousness. But elsewhere we find another ideal: the laughing sage, the playful thinker. These are models of intellectual playfulness. Intellectual playfulness, I suggest, is the disposition to try out alternate belief systems for fun – to try on radically different perspectives for the sheer pleasure of it. But what would the cog-nitive value be (...) of such playfulness? I suggest that intellectual playfulness function as, at the very least, a kind of intellectual insurance policy against epistemic traps. An epistemic trap is a belief system that re-directs good-faith inquiry to bad results. Am epistemic trap manipulates background beliefs to fend off contrary evidence. For example, a conspiracy theory might include a set of beliefs about how the mainstream media has been taken over by some vicious cabal. Normal epistemic attempts will be captured by a well-wrought epistemic trap, because normal attempts at inquiry are guided by these background beliefs -- which set what counts as a plausible path to explore, and what is implausible or beyond the pale. And a clever epistemic trap will manipulate those background beliefs for ill effect. Intellectual playfulness, on the other hand, isn’t motivated by an epistemic interest in the truth, but in the sheer pleasure of intellectual exploration. Since intellectual playfulness isn’t oriented towards the truth, it won’t be constrained by an agent’s background beliefs – it won’t, for example, prefer to investigate apparently more plausible pathways. Intellectual playfulness offers an opportunity to escape from epistemic traps. But intellectual playfulness has its own limitations. It will only drive us to explore belief systems when that exploration is fun. What we need is an array of differently-motivated exploratory tendencies – empathy, curiosity, playfulness – each of which will each cover for the others’ limitations. (shrink)

ObjectiveThe goal of the study was to explore the relationship between parent–children relationships related to using the internet among kids and potentially associated factors.Materials and MethodsA sample of 1.216 Vietnamese students between the ages of 12 and 18 agreed to participate in the cross-sectional online survey. Data collected included socioeconomic characteristics and internet use status of participants, their perceived changes in relationship and communication between parents and children since using the internet, and parental control toward the child’s internet use. Ordered Logistic Regression was carried out to determine factors associated with parent–children relationship since using the internet.ResultsThe characteristics of the relationship between children and their parents since using the Internet were divided into three levels: deterioration, stability, and improvement. The topics that children most often communicate with their parents include learning, housework, and future directions. Two-way interactive activities, such as supporting parents to use the Internet, have a positive impact on the parent–child relationship. Stubborn parental control, such as establishing rules about contact or allowing Internet access and setting up global positioning system to track negatively affecting parent–child relationships.ConclusionFindings indicated that changes in the quality of the parent–child relationship were self-assessed by participants regard to kids’ internet use, especially in the COVID-19 epidemic context. Educational campaigns and programs to raise awareness of parents as to the dangers and negative influences that their children may encounter online, psychology of children’s behaviors and effects of different responding strategies are recommended. Community and stakeholder support for marine and coastal ecosystem conservation policies is crucial. However, extant multinational studies on climate change-related factors that constrain stakeholders’ willingness to protect the ocean are limited. Therefore, the dataset from 709 marine stakeholders across 42 countries, part of the MaCoBioS project funded by the European Commission, was analyzed using the Bayesian Mindsponge Framework (BMF) method to fill the knowledge gap. The findings reveal that for individuals who think society is doing too much to address climate (...) change, new technologies can solve climate change. Responses to climate change can damage the country’s economy and might not be productive in supporting actions protecting the ocean. Based on the study results, we recommend policymakers raise awareness among individuals engaged in marine and coastal ecosystems about the crucial role of marine protection in combating climate change, taking into account the limitations of technology in solving climate change problems and the inadequacy of current efforts. The findings also provide insights for enhancing the effectiveness of awareness and knowledge-raising campaigns, conservation programs, and eco-surplus culture-building agenda. (shrink)

Scientific integrity is defined as the condition that occurs when individuals adhere to accepted standards, professional values, and practices of the relevant scientific community. This study aims to investigate the influential factors on the scientific integrity in scholarly publishing of researchers in Thailand. The questionnaire was delivered to a sample size of 398 top researchers who had high citations and h-index recorded in the Scopus database during the past 5 years, 316 responses were returned. The findings confirm that there are (...) five factors that affect scientific integrity in scholarly publishing: university/faculty requirements/policies, university support, aspects of publishing, publisher aspects, and researcher-related factors. It is evident that establishing a process and criteria for authorship agreement and verification, as well as dedicating offices or units within the university to address research integrity concerns and provide support to researchers, exhibit the highest factor loading values. The findings ensure that scientific integrity stands out as a top priority for researchers linked with prominent research universities in Thailand. To tackle this challenge, it is recommended for the universities to prioritize initiatives aimed at enhancing researchers’ ethical awareness and nurturing scientific integrity. (shrink)

Nguyen argues that only his radically pragmatic account and Sterken’s indexical account can capture what we call the positive data. We present some new data, which we call the negative data, and argue that no theory of generics on the market is compatible with both the positive data and the negative data. We develop a novel version of the indexical account and show that it captures both the positive data and the negative data. In particular, we argue that there is (...) a semantic constraint that, in any context, the semantic value of GEN is upward monotone and non-symmetric. On the other hand, the pragmatic account has difficulty accommodating the negative data. This is because no pragmatic principles have been developed that can explain the negative data. In the paper, we focus on only the pragmatic account and the indexical account, but our discussion has broad implications for the debate on generics: any empirically adequate accounts of generics must be flexible enough to accommodate the positive data and yet constrained enough to accommodate the negative data. Scientific discourse is rife with passages that appear to be ordinary descriptions of systems of interest in a particular discipline. Equally, the pages of textbooks and journals are filled with discussions of the properties and the behavior of those systems. Students of mechanics investigate at length the dynamical properties of a system consisting of two or three spinning spheres with homogenous mass distributions gravitationally interacting only with each other. Population biologists study the evolution of one species procreating at a constant (...) rate in an isolated ecosystem. And when studying the exchange of goods, economists consider a situation in which there are only two goods, two perfectly rational agents, no restrictions on available information, no transaction costs, no money, and dealings are done immediately. Their surface structure notwithstanding, no competent scientist would mistake descriptions of such systems as descriptions of an actual system: we know very well that there are no such systems. These descriptions are descriptions of a model-system, and scientists use model-systems to represent parts or aspects of the world they are interested in. Following common practice, I refer to those parts or aspects as target-systems. What are we to make of this? Is discourse about such models merely a picturesque and ultimately dispensable façon de parler? This was the view of some early twentieth century philosophers. Duhem (1906) famously guarded against confusing model building with scientific theorizing and argued that model building has no real place in science, beyond a minor heuristic role. The aim of science was, instead, to construct theories, with theories understood as classificatory or representative structures systematically presented and formulated in precise symbolic.. (shrink)

Background: Treatment of psychotic disorders in pregnancy is often ethically and clinically challenging, especially when psychotic symptoms impair decision-making capacity. There are several competing ethical obligations to consider: the ethical obligation to maternal autonomy, the maternal and fetal beneficence-based obligations to treat peripartum psychosis, and the fetal beneficence-based obligation to minimize teratogenic exposure. Objective: This article outlines an ethical framework for clinical decision-making for the management of chronic psychosis in pregnancy, with an emphasis on special considerations in the previable and (...) periviable period. Case Presentation: A 31-year-old gravida 2, para 1 with intrauterine pregnancy at 12 weeks and 4 days gestation was brought to the emergency department by her husband seven months after delivering her first child, due to sudden onset of behavioral changes that included self-isolation, not eating, and not taking care of her child. Her past medical history included hypothyroidism and inflammatory bowel disease, but no prior psychiatric illness. After being admitted to the psychiatric hospital, she continued to have poor oral intake and weight loss despite initial inpatient treatment with antipsychotics, levothyroxine, and discontinuation of corticosteroids. Her pregnancy was also complicated by the diagnosis of multiple fetal anomalies at 20 weeks gestation, when the fetus was periviable. Conclusions: For previable or periviable pregnancies, the patient and/or surrogate should decide whether to pursue prenatal genetic screening and invasive diagnostic testing, as well as whether to continue or terminate the pregnancy. When the choice is made to continue the pregnancy, initiation of long-term psychiatric treatment (including medications with potential adverse fetal effects) should be based on shared decision-making between the physician and the patient and/or surrogate. Although some pharmacologic interventions may have potential adverse effects on the developing fetus, the use of psychotropic medications can be ethically justified, even if the patient herself does not have the capacity to consent and requires a surrogate, when the goal is to restore maternal autonomy and minimize the risks of maternal and fetal harm from untreated psychiatric illness. In his recent work, Dretske offers a new account of what it is for a mental state, in particular, a sensory experience, to be conscious. According to Dretske’sproposal, subject S’s experience of object O is conscious if and only if it makes S aware of O. This proposal is argued to be open to only two serious interpretations. The first takes it to mean that S’s experience of O is conscious if and only if it constitutes S’s awareness of O, (...) whereas the second takes it to mean that S’s experience of O is conscious if and only if it causes S’s awareness of O. It is argued that neither is a plausible way to understand the nature of state consciousness, because the constitutive interpretation implausibly denies the existence of unconscious veridical experiences, whereas the causal interpretation implausibly casts S’s veridical experience of O, rather than O or a certain external event involving O, as the relevant cause of S’s awareness of O. In a series of closely connected papers, Rosenthal has defended what has come to be known as “the higher-order thought theory of state-consciousness.” According to this theory, a mental state which one instantiates is conscious if and only if one is conscious of being in it in some relevant way, and one’s being conscious of being in the state which is conscious consists in one’s having a contemporaneous thought to the effect that one is in that state. The main aim (...) of this paper is to disarm a Searle-style objection to Rosenthal’s account of state-consciousness, one that takes mentality, in particular intentionality, to presuppose state-consciousness. It is argued that the Searlean attempt to convict Rosenthal’s hypothesis of circularity fails, because the postulation of what Searle called “subjective ontology,” as well as the requirement that there be an uncancelable connection between mode of representation and state-consciousness, is unreasonable. While defending Rosenthal against Searle, this paper also aims to develop a fresh objection to the higher-order thought conception of state-consciousness. (shrink)
